Användarvillkor

2.1.

Dessa Användarvillkor reglerar din användning av Webbplatsen och alla relaterade tjänster (hädanefter "Tjänsterna"). Dessa Användarvillkor kan publiceras på flera språk. Vid eventuella konflikter mellan den engelska versionen av dessa Användarvillkor och versioner publicerade på andra språk har den engelska versionen företräde.

2.4.

Alla spel, lotterier eller spelmarknader som görs tillgängliga på Webbplatsen som en del av Tjänsterna kan också omfattas av egna regler, som du bör hänvisa till när du deltar. Bestämmelserna i dessa Användarvillkor har företräde vid eventuell konflikt med sådana regler.

Vi ansvarar inte för några förluster eller skador som uppstår till följd av missbruk av ditt LuckyAnon-konto av tredje part på grund av ditt avslöjande, vare sig avsiktligt, oavsiktligt, aktivt eller passivt, av sådan information till tredje part.

3.4.

Du får endast ha ett LuckyAnon-konto. Om du försöker öppna fler än ett LuckyAnon-konto kan alla sådana konton blockeras, stängas av eller avslutas och alla belopp som krediterats till dessa konton kommer att frysas och kan dras av. Om du upptäcker att du har öppnat fler än ett registrerat LuckyAnon-konto måste du omedelbart meddela oss via e-post till [email protected].

3.5.

Om du när som helst efter registreringen av ditt LuckyAnon-konto upptäcker några fel eller felaktig information som rör ditt LuckyAnon-konto måste du informera oss om detta så snart som möjligt via e-post till [email protected].

4.1.

As a condition of your use of the Services, you represent, warrant, covenant and agree that:

• You are the older of (i) 18 years of age and (ii) the legal age determined by any laws applicable to you regarding your use of the Website and the Services;
• You have full capacity to enter into a legally binding agreement with us and you are not restricted by any form of limited legal capacity;
• Your use of the Services is at your sole option, discretion and risk;
• You are fully aware that there is a risk of losing funds when using the Website and the Services and you agree that we bear no responsibility to you for any such loss;
• You acknowledge that the funds in your LuckyAnon Account are consumed instantly when playing games and that we do not provide refunds;
• You accept and acknowledge that the prevailing market value of cryptocurrencies can change dramatically;
• You have not been diagnosed or classified as a compulsive or problem gambler;
• You are not currently self-excluded from any gambling site or gambling premises, and you will inform us immediately if you enter into a self-exclusion agreement with any gambling provider;
• You are accessing the Website from a jurisdiction in which it is legal to do so, and will not use our Services while located in any jurisdiction that prohibits the placing and/or accepting of bets online and/or playing casino and/or live games or which otherwise prohibits access to or use of the Services;
• All information that you provide to us during the term of validity of these Terms of Service is true, correct and complete, and that you will immediately notify us if any such information changes;
• You participate in the LuckyAnon games strictly in your personal and non-professional capacity and for recreational and entertainment purposes only;
• You participate in LuckyAnon games on your own behalf and not on behalf of any other person;
• You will not use or access the Website or Services for any purpose that is (1) illegal under any law applicable to you or (2) prohibited by or in breach of these Terms of Service;
• You will not collude with or assist, or attempt to collude with or assist, any third parties, or use any device, robot, spider, algorithm, software, routine or other method (or anything in the nature of the foregoing), in order to defraud us or interfere with the functioning or operational performance of the Website or the Services;
• You will not use the Website or Services in any way which interferes or may interfere with other users, or make any attempt to gain an unfair advantage over other users, whether specifically prohibited by the applicable rules or not;
• You will not disseminate any information which is unlawful, harassing, abusive, threatening, libellous, defamatory, obscene, indecent, inflammatory, racially or ethnically objectionable, pornographic or profane, or any material that could constitute or encourage conduct that would be considered a criminal offence or could give rise to civil liability;
• In relation to deposits and withdrawals of funds into and from your LuckyAnon Account (including cryptocurrencies and any other currencies that may be used from time to time), you will only use funds which have been legally obtained and which belong to you. You will not use funds which originate from criminal or other illegal or unauthorised activities;
• You acknowledge that we may take measures to detect and prevent unauthorised or illegal activity. These steps may include, but are not limited to, examination of your device properties, geolocation, detection of IP masking, and blockchain transaction analysis;
• If you become aware of any suspicious activity relating to any of the games on the Website, you will report this to us immediately by contacting us by email at [email protected];
• You acknowledge that we may suspend, block or close a LuckyAnon Account and withhold funds if we deem it necessary to assist in the prevention of money laundering or other illegal activity;
• You are fully and solely responsible for obtaining your own independent financial, accounting and tax advice, and for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on any winnings or other sums that you receive from using the Services;
• You will keep your username, password and cryptocurrency wallet private keys confidential and take appropriate steps to prevent unauthorised access or use;
• You will immediately change your password and notify us if your username or password is compromised in any way;
• You agree not to open more than one LuckyAnon Account;
• You acknowledge that we may modify or withdraw any of the Services at any time without prior notice to you; and
• You acknowledge that we are not liable for any outages, slowness, capacity constraints or other deficiencies affecting the telecommunications networks or internet services required for you to access and use the Services.

4.2.

In relation to the Platform and Games provided by third-party suppliers, you acknowledge and agree to the following:

• Your sole recourse in relation to any complaint, dispute or claim related in any manner to third-party supplier services is through LuckyAnon;
• You will use the Platform only for the playing of the Games in accordance with LuckyAnon's terms and conditions and the terms and conditions applicable to each Game;
• LuckyAnon shall monitor unusual patterns of gameplay, atypical play patterns and/or suspicious deposits and withdrawals patterns;
• LuckyAnon has the right to void and cancel bets and recover winnings where there has been an incorrect payout or the Game has been subject to fraudulent manipulation or tampering by you in such a way that you are able to cheat, influence the outcome of such Game, or otherwise create an unfair advantage in the outcome of a Game to your own benefit;
• You will not reverse engineer or decompile any supplier's software or back-office tools, modify, remove or obscure any proprietary notices placed on the Platform, copy the Platform by any means for any purpose whatsoever, attempt to derive source code or other confidential information from the Platform or use the Platform for any purpose other than playing the Games or in any way that could adversely affect any supplier's name, image or reputation; and
• Third-party suppliers shall be given a right of direct action to enforce, for their own and their group's benefit or the benefit of your terms and conditions, for the purpose of enforcing directly against you any breach of the restrictions set out in the preceding paragraph in relation to their Games.

5.1.

The Services are provided to you on an "as is" basis. We disclaim any and all warranties, expressed or implied, in connection with the Services. In particular, we provide you with no warranty or representation whatsoever regarding the Services' quality, fitness for purpose, completeness, or accuracy, and we make no warranty that any Service will be uninterrupted, timely or error-free, or that any defects will be corrected. In particular, LuckyAnon does not represent or warrant that the Website is or will be free from errors, bugs and other defects in its functioning, that access to the Services is or will be continuous, uninterrupted, timely, or secure, that the information made available via, contained on or used by the Website, including data feeds used for sports betting, is or will be accurate, reliable, complete, or current, that the Website will be free from viruses or other harmful material, or that the Website will be suitable for the particular purpose that you have in mind when using it. Information made available via, contained on or used by the Website may be inaccurate or incomplete or otherwise unreliable for a variety of reasons, for example as a result of software bugs, data feed interruptions, platform or server downtime, or other issues, and this may cause losses to you by affecting the functioning of the Services or the resolution of Markets. Links and frames connecting the Website with other websites are for convenience only and do not mean that we endorse or approve those other websites, their content or the people who run them.

5.2.

6.2.

LuckyAnon kan då och då testa nya spel och andra funktioner på Webbplatsen genom att introducera dem i form av betatestning ("Betafunktioner"). Om du väljer att använda dessa Betafunktioner gör du det med vetskap om att (i) sådana funktioner kan vara särskilt instabila och benägna till fel och buggar och andra defekter i funktion och (ii) LuckyAnon inte kommer att vara ansvarig för några förluster som uppstår som ett resultat. Persons located or resident in Australia, the British Virgin Islands, the Cayman Islands, Comoros, Germany, the Netherlands, Singapore, Spain, St. Kitts and Nevis, the United Arab Emirates, the United Kingdom, the United States of America and any other location from which use of the Services is not permitted under applicable laws or regulations or where provision of the Services would require licensing or registration or which is embargoed by the United States of America, the European Union or the United Kingdom (the "Prohibited Jurisdictions") are not permitted to access the Website or the Services. These restrictions apply equally to residents and citizens of other jurisdictions while they are located in a Prohibited Jurisdiction.

7.1.

We take no responsibility for any delays to deposits which may arise from or be associated with blockchain transaction times or the use of particular payment methods or which may be caused by any third party.

We reserve the right to use additional procedures and means to verify your identity when processing deposits into your LuckyAnon Account.

7.6.

Please note that the use of some payment methods may involve additional fees. Your bank or payment service provider may also charge you additional fees for making transfers or converting currencies.

7.7.

We may refuse to credit any deposits at our own discretion. If your LuckyAnon Account has been blocked or suspended, you must refrain from attempting to deposit funds into it. Should you attempt to deposit funds when your LuckyAnon Account is blocked or suspended, (i) you acknowledge and accept the risk that such deposited funds may be permanently lost, and (ii) if those deposited funds are not lost, we will have the right to retain them.

7.8.

All deposits are subject to a 1x playthrough requirement before withdrawal. This means you must wager the amount of your deposit at least once before being eligible to withdraw those funds or any associated winnings.

8.1.

9.3.

Om vi av misstag krediterar ditt LuckyAnon-konto med vinster eller andra belopp som inte tillhör dig, oavsett om det beror på tekniskt fel eller mänskligt fel eller annat, förblir sådana belopp vår egendom och kommer att vara föremål för avdrag från ditt LuckyAnon-konto. 9.4.

Om ditt LuckyAnon-konto har avslutats, låsts, blockerats eller uteslutits och du önskar återfå medel som hålls på det, vänligen kontakta LuckyAnon kundtjänst på [email protected]

9.5.

En session är föremål för en maximal vinstgräns på $1 000 000. Eventuella vinster som överstiger detta belopp kan annulleras enligt vårt gottfinnande.

9.6.

10.1.

Alla spel placeras i en specifik digital tillgång eller kryptovaluta. Eventuella värden uttryckta i fiatvaluta, inklusive USD, tillhandahålls endast för orienterings- och referensändamål.

10.2.

Dina vinster kommer att betalas ut i samma tillgång eller valuta som användes för att placera spelet för det spelet.

10.3.

10.5.

10.6.

10.7.

If the outcome of a Market was already known or decided before the placing of a bet, the bet will be void and any winnings may be withheld or deducted and wager amounts returned.

10.8.

Betting may be voided in the case of any incorrectly displayed or calculated prices.

10.9.

Bets are void on postponed, cancelled, or abandoned Matches. Matches which have their start date altered well in advance to accommodate live TV, or to ease fixture congestion will not be classed as postponed. An abandonment is where a match is halted before the completion of the allocated match time and not played out to conclusion on the same day. Markets which have already been determined at the time of abandonment, such as 'First Team to Score', will stand. The Market must be fully determined for bets to stand.

10.10.

If a Market is incorrectly settled, LuckyAnon reserves the right to correct it at any time.

10.11.

For prop bets, the following terminology applies:

• "Player must play": applies to all pre-match player prop markets across NBA, NHL, NFL, CBB, and CFB and all in-play player prop markets across MLB, NBA and NFL.
• "Player must start": all prematch MLB player prop markets (pitcher and batter markets) are "Player must start". Bench player markets are not available for pre-match betting. NHL goalie markets are "Goalie Must Start".

10.12.

The following rules apply to prop bets:

• LuckyAnon reserves the right to void bets placed on known outcomes or known results.
• Settlements are sourced from the official league data in the box scores: nfl.com, nba.com, mlb.com, and nhl.com.
• Bets are void on postponed, cancelled, or abandoned matches.

10.13.

"Cash Out" is a feature that offers the customer the opportunity to take a return on a bet placed before the bet has reached its conclusion. To Cash Out (where available), click on the Cash Out button next to your bet. The Cash Out amount will then be credited to your account. Once you have chosen to Cash Out, your bet will be deemed concluded and will be unaffected by the final outcome of the relevant event.

10.14.

The following also applies to the Cash Out feature:

• (a) Cash Out will not be available on certain Markets and events.
• (b) A time delay is applied on every Cash Out.
• (c) Cash Out will not be available if the event and/or Market you have placed a bet on is suspended.
• (d) A Cash Out attempt may not be successful if a Market or event is suspended or odds change during the time delay period applied after Cash Out is attempted.
• (e) Where Cash Out is available on a pre-match event, if we do not cover the event live then Cash Out will be unavailable once the event starts.
• (f) Your Cash Out value will differ depending on how your selection is performing and may be higher or lower than your original stake.
• (g) LuckyAnon reserves the right to reverse the settlement of a Cash Out on any bet that has been settled in error.
• (h) LuckyAnon will not be responsible in the event that Cash Out is unavailable because of technical issues. Any bets will be settled as normal based on the final result.
• (i) LuckyAnon reserves the right to remove a customer's ability to use the Cash Out feature, or to nullify any use of such feature, in the event of misuse or any other breaches of these Terms of Service.

11.1.

12.1.

Utan att det påverkar några andra rättigheter, om du bryter helt eller delvis mot någon bestämmelse som finns häri, förbehåller vi oss rätten att vidta sådana åtgärder som vi anser lämpliga, inklusive att avsluta eller stänga av ditt LuckyAnon-konto och/eller dra av medel från det, avsluta vårt förhållande med dig enligt dessa Användarvillkor eller andra avtal och/eller vidta rättsliga åtgärder mot dig.

12.2.

Du håller härmed helt skadeslöst, försvarar och skyddar LuckyAnon och dess aktieägare, styrelseledamöter, anställda och ombud mot alla kostnader, utgifter, förluster, skadestånd, anspråk, krav och skulder (inklusive juridiska avgifter och andra avgifter) som kan uppstå eller drabbas av LuckyAnon eller dess aktieägare, styrelseledamöter, anställda och ombud, uppstående på något sätt från (i) eventuellt brott mot någon del av dessa Användarvillkor från din sida; (ii) eventuellt brott mot någon lag eller tredje parts rättigheter från din sida; eller (iii) din användning av Tjänsterna.

13.1.

Under inga omständigheter kommer vi att vara ansvariga för eventuella anspråk, förfaranden, skulder, kostnader, förluster eller särskilda, tillfälliga, direkta, indirekta eller följdskador (inklusive, utan begränsning, skador för förlust av affärsvinster, avbrott i verksamheten, förlust av affärsinformation eller andra ekonomiska förluster) uppstående från användning eller missbruk av Tjänsterna. Denna ansvarsbegränsning gäller (1) oavsett om det påstådda ansvaret är baserat på kontrakt, skadeståndsrätt, strikt ansvar, lagstadgat ansvar eller någon annan grund, (2) även vid vår egen vårdslöshet och (3) även om vi har blivit medvetna om möjligheten till sådant ansvar.

13.2.

Ansvarsbegränsningarna i dessa Användarvillkor gäller i största möjliga utsträckning enligt tillämplig lag.

16.1.

These Terms of Service will be governed by, and construed in accordance with, the laws of Costa Rica.

16.2.

The courts of Costa Rica will have non-exclusive jurisdiction to settle any dispute arising from or connected with these Terms of Service (including a dispute relating to their existence, validity or termination, or the consequences of their nullity, or any non-contractual obligation arising out of or in connection with them).

16.3.

You must bring any and all legal claims under these Terms of Service in your individual capacity and not as a claimant in or member of any purported class action, collective action, private attorney general action, or other representative proceeding. You agree to waive the right to demand a trial by jury, where applicable.

19.1.

No waiver by us of any breach of any provision of these Terms of Service shall in any way be construed as a waiver of any subsequent breach of such provision or of any breach of any other provision of these Terms of Service.

19.2.

Nothing in these Terms of Service shall create or confer any rights or other benefits in favour of any third parties.

19.3.

Nothing in these Terms of Service shall create or be deemed to create a partnership, agency, trust arrangement, fiduciary relationship or joint venture between you and us.

19.4.

Any communications with us regarding use of the Services shall be retained for a period of six years.

19.5.

These Terms of Service constitute the entire understanding and agreement between you and us regarding the Services and supersede any prior agreement, understanding, or arrangement between you and us.
